Evidence is divided into two categories: agreed upon and disputed. The author said:

الأدلة قسماني متفق عليها ومختلف فيها قال الناظم

“Secondly, some proofs are disputed, while others are characterized by consensus.” So evidence is divided into two categories.

وثانيا أدلة منها اختلف فيه وبعض بالوفاق يتصف فالأدلة قسمان

Some are disputed, and some are characterized by consensus—that is, the scholars agree on them. These are the disputed and agreed-upon proofs. Then he said:

منها ما اختلف فيه ومنها ما اتصف بالوفاقي يعني اتفق عليه العلماء وهذه الأدلة المختلفة وماتتفق عليه ثم قال

All right, why did he say, “Secondly, some proofs are disputed, while others are characterized by consensus”?

طيب ليش يا وثانيا أدلة منها اختلف فيه وبعض بالوفاق يتصف

Why mention the agreed-upon ones afterward? Shouldn’t they have come first? No.

لماذا أخرى المتفق عليها وحقها أن تقدم ليس

No, so that the pronoun in “they” refers back to them. That’s it.

He said, “Some are characterized by consensus,” meaning the disputed proofs. As for those agreed upon, he said: “They are the Book”—

قالوا بعضا بالوفاق يتصف وهي يعني الأدلة المختلفة فالمتفق عليها قال وهي الكتاب

with a still هاء: the Book, the Quran, the Sunnah—the Prophet’s Sunnah, peace and blessings be upon him—

For two reasons. What are they? Good, because it is not independent. Good. So there are three reasons.

Its analogy—no, he didn’t say “their analogy.” “Its analogy” means the analogy of the Quran, the Sunnah, and consensus.

قياسها لا ما قال قياسهما قياسها يعني قياس الكتابي وقياس السنتي وقياس الإجماعي

That is, if something is reported from the Companions and we accept the authority of their statements, we can draw an analogy from what they reported. But of course, there are two reasons. The first reason is

يعني إذا ورد عن الصحابة وقلنا بحجية قول الصحابة فنقيسه على ما ورد عن الصحابة ولكن طبعا سببان السبب الأول

for the meter. All right, but the second reason is that he didn’t use it for the meter, even though that would compromise the meaning.

للوزن طيب لكن السبب الثاني يعني ما أتى به للوزن مع إخلال بالمعنى

is analogy based on the Quran, the Sunnah, or consensus. But if you draw an analogy based on a Companion’s statement, is that analogy agreed upon? No, because the authority of a Companion’s statement is itself disputed. So its analogy is a matter of

whether or not. Is that clear? So, “its analogy”—did you see these verses in the poem? Number four, or what number?

أو لا واضح شيء فهل قياسها شفت هذه أشرار النظم رقم أربعة ولا رقم كم

He said, “its analogy,” meaning the analogy of the agreed-upon proofs. Then he said, “There is disagreement about others.” These four proofs are agreed upon, and there are other proofs about which there is disagreement. He said:

قال قياسها يعني قياس الأدلة متفق ثم قال في غيرها نزاع هذه الأدلة الأربع متفق عليها وهيها من أدلة فيه نزاع فقال

What is disputed? First: “a law that came before”—meaning a law revealed before us.

ما الذي فيه النزاع قال واحد شرع مضى يعني شرع من قبلنا

The second is what the Companions said. Who are the Companions? The Prophet’s Companions, may God be pleased with them. Calling them “the Companions” is a usage among scholars, is it not?

الثلين ما قاله الأصحاب الأصحاب من هم الصحابة رضي الله تعالى عنهم وتسميتهم بالأصحاب مستعمل عندها للعلم ألا لا
